THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Your health record contains personal information about you and your health. State and federal laws protect the confidentiality of that information. “Protected Health Information” (“PHI”) refers to any information that identifies you and relates to your past, present, or future physical or mental health condition, substance use, or healthcare services.

The confidentiality of alcohol and drug treatment records is specifically protected under 42 C.F.R. Part 2 and the Health Insurance Portability and Accountability Act of 1996 (HIPAA). These combined laws restrict most disclosures without your written authorization. Exceptions apply only in specific limited circumstances—for example, for medical emergencies or in response to a court order issued under the required procedures. Any violation of these laws is a serious matter and may be reported to the appropriate authorities.

If at any time you believe your privacy rights have been violated, you have the right to file a complaint (see the “Complaints” section below).

How We May Use and Disclose Health Information About You

For Treatment

We may use and disclose your medical information to provide, coordinate, or manage your treatment and related services. This can include communication with healthcare professionals, laboratories, or referral sources involved in your care.

For Payment

With your authorization, we may use and disclose your PHI to obtain payment for services rendered. Examples include verifying insurance benefits, processing claims, or coordinating reimbursement with government programs or other payors.

For Healthcare Operations

We may use your PHI as needed for our internal operations—such as quality assessment, staff training, accreditation, licensing, audits, and compliance monitoring. For example, we may use a sign-in sheet or call your name in a waiting area. Business associates performing administrative functions (billing, data processing, etc.) are required by contract to safeguard your PHI and maintain confidentiality.

Without Authorization

Certain limited disclosures may occur without your written permission if required or permitted by law. Examples include:

  • Medical emergencies
  • Reporting suspected child abuse or neglect
  • Oversight activities by government health agencies
  • Compliance investigations by the U.S. Department of Health and Human Services (HHS)
  • Court orders that follow the specific federal procedures for disclosure of treatment records
  • Reporting crimes committed on the premises or against personnel
  • Vital-statistics or coroner requirements for deceased patients

With Authorization

All other uses or disclosures of your PHI will only occur with your written authorization. You may revoke that authorization in writing at any time, except to the extent actions have already been taken based on it.

Your Rights Regarding Your Protected Health Information

Right to Access, Inspect, or Copy

You have the right to review or obtain a copy of your PHI used to make decisions about your care. Requests must be made in writing. We may charge a reasonable, cost-based fee for copies. In certain limited cases, access may be denied, but you will be informed of your rights to appeal.

Right to Amend

If you believe information we maintain is incomplete or inaccurate, you may request an amendment in writing. If a request is denied, you may submit a written statement of disagreement, which will be added to your record.

Right to an Accounting of Disclosures

You may request an accounting of certain disclosures of your PHI made during the past six years, excluding those made for treatment, payment, or operations, or disclosures authorized by you. Reasonable fees may apply for more than one request in a 12-month period.

Right to Request Restrictions

You have the right to request restrictions on how we use or disclose your PHI for treatment, payment, or operations. We are not required to agree to a requested restriction, but if we do, we will comply with it.

Right to Request Confidential Communications

You may request that we contact you by alternative means or at an alternative location (e.g., at work or by mail). We will accommodate reasonable, written requests.

Right to a Paper Copy of This Notice

You may request a printed copy of this Notice at any time, even if you originally received it electronically.

Right to Receive a Copy of Revised Notices

We reserve the right to revise this Notice and to make the new Notice effective for all PHI we maintain. Any updates will be posted on our website, provided upon request, and available at our facility.
